Terms and conditions agreement:

 

Frosty Models DATA Collecting Personal Information 

Our site provider will collect certain information about your device if you accept cookies on the first page visit. We use this to better your interaction with the site, and information is necessary to process your purchases. Personal Information gathered at this stage is only to better suit the buyer experience using AI analytics.

Device information 

 

  • Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the site, including items you may put in the checkout cart.

  • Why we collect this information: Products or services you enquire or purchase can be logged and we then fulfil our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, changes in orders, communicate with you, check for fraud or miss use of information and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services. This gives us the right to contact you and thus you contact us with any orders.
  • Personal Information collected *only after registration and or placed order complete: name, billing address, shipping address, payment information (credit card information is in no way process by the business of Frosty Models or its staff - this is all handled by a verified transaction service, such as PAYPAL - never give or share payment or passwords via email, and confirm with only our emails, which must end in @frostymodels.co.uk or the credit transaction provider), email address, and phone number. 

 

Customer support information 

 

  • Frosty Models will hold all contact information (not payment details) to be able to keep in contact with the buyer, to provide information - such as: Recalls, product issues, incorrect orders and such.

Analytic Advertising 

We may use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. To unsubscribe to this service, please use the link at the bottom of the email to remove, or contact Frosty Models. 

 

Lawful administration law for safeguarding 

The General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your personal information under the following lawful bases:

  • The performance of the contract between you and the Site; 
  • Compliance with our legal obligations; 
  • To protect your vital interests; 
  • To perform a task carried out in the public interest; 
  • For our legitimate interests, which do not override your fundamental rights and freedoms.

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Keeping information for an indefinite period

Once you place an order through the Site, Subscribe or create an Online Account, we will retain your Personal Information for our records unless and until you ask us to erase this information. Simply contact Frosty Models to request for this.

 

 

Your rights & Our Business rights

We reserve the right to cancel any order if we feel the order was placed incorrectly, maliciously, or by fraudulent means.

We hold the right to give or take away any discounts previously given, advertised or promised.

Stock Issues

If there is a product showing instore online, and for any which reason - the stock is incorrect, we reserve the right to fulfil this order by reordering supplier stock. If we do this, we must either be in contact with buyer to request more time, offer credit or fully refund the items in full or part order - in some cases, the order may be split, and the partial order will be sent ahead. 

Changes to stock within store or online - variations of colour, branding, quantities (not extending to consumer quality rights)

From time to time, products change, as does other variations, we must state this is a fact, and can sometimes be noted by version changes. In some cases, you may receive a 'superseded' part that has replaced a previously ordered part. We will try to update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons on stocked items details, photos, version etc. 

Complaints 

For immediate issues, please either see Frequently asked Questions, or call/email. We will not accept instore complaints without prior knowledge. This is to ensure we have the time, and staff dedicated to the customers complaint needs, and we reserve the right to refuse exchange, or refund after the 14day cooling off period online and 30 days instore. (If customer is not satisfied - items must be unused and in a condition for resale - if there is no issue, other than personal preference issues). 

 

Quality complaints - We will endeavour to replace any items which are not up to standard. We will not refund items, if we can replace within 24hours. If problem persists, a full refund, exchange for another product or store credit will be applied. 

 

Misuse - Products that show sign or tamper, misuse or third party damage (such as water ingress) will be rejected for refund. We may be able to advise proper use and or training, repair at a cost (Frosty Models Discretion) 

 

Online selling - Distance selling act: Once the order is cancelled, the consumer has 14 days to return the goods, and the refund must be made within 14 days of the goods being received by the seller. A consumer holds the rights to order online, review the product with 'reasonable means' and request a return, exchange or refund. To do this, please email with the order details to admin@frostymodels.co.uk

Note: We will endeavour to help any consumer with their product, and we hold the right to extend any warranty or repairs at the cost to Frosty Models, by using Goodwill, for those of genuine complaint and or loyalty. 

 

Warranty claim - Most companies will need you to register a product after purchase on their online site. You may need to provide a receipt for this. The warranty period will then start. You should be able to claim this online - however, any issues - we are here to help.

 

Online & Instore Opening Hours

 

As a new store, we may alter our opening times - however, we are duty bound to provide an advertised 40 hours a week for sales support, typically 9am till 5pm Monday To Friday. We reserve the right to alter these hours (with prior advertisement) to able us for store downtime for packing and restocking.

 

Ordering online - all details of shipping options are provided in our shipping page. All other details should apply per listing. Collecting items instore: We would typically pick within 1 hour of store opening hours, ready for collection within the hour. Either contact us or await the ''order ready for collection'' email.

 

Purchasing instore - although our store is open, we reserve the right to hold stock from sale for online purchases, and we reserve the right to change prices instore vs online to target aim special deals. For example ''online only price'' or ''instore only price''.

Ownership of goods -

 

All goods remain the property of Frosty Models until paid in full. Any part payments, can be cancelled and refunded at 100% on stocked items only at anytime. If the order was a special order a 10% restocking fee will be deducted from any full or partial payment to cover costs incurred.

RETURNS & REFUND POLICY

To return any item instore or online, see details above. Details of the item requirements to be met are below.

 

A Return and Refund policy usually consists of:

 

  • Terms of return (14 days if purchased online) instore we will refund any purchase that was ''in error'' within 24 hours. Damaged goods are subject to UK Law of 30 days of receipt. *Terms Apply*
  • Shipping and or cost of repair - To return items, the consumer will have to cover the return shipping costs. A restocking fee of 10% and a none refund of initial shipping costs will be deducted for returns that were purchased ''in error''. If the item needs repair, the buyer may be charged if the item has been damaged due to 'reasonable use' and return shipping costs will apply.
  • Reason for return (e.g. damaged or wrong product must be stated)
  • How to process a return (contact us by any means, stating any of the above in this section that applies)
  • Process of refund (i.e. refunds may either be instant - however, if a warranty claim, this will depend on the manufactures current details found on their websites - credit card transaction providers, online or instore normally take 3-5 working days for refunds)
  • Full receipt from either instore or online (we may not accept a return without I.D to prove ownership or receipt)
  • Product must of been purchased through ourselves (with proof)
  • Damaged items, misuse and overuse may be rejected for return. As long as all consumer rights are applied. 

 

Note, we reserve the right to extend gratitude, if the consumer is polite and in good willing - to receive further assistance or time. Abuse will be reported to police, and thefts or fraud will also be investigated, and we reserve the right to ban or suspend any account for further criminal investigation. We can also refuse entry from reported offenders of local crime stoppers and or reasonable suspicious activity.
